Today a judge ruled Pablo Abreu-Pena will remain in custody as his case goes through the judicial system.
In August, Albuquerque police tried to arrest Abreu-Pena when they say he pointed a gun at police.
Officers opened fire, shooting and wounding him. Abreu-Pena is charged with aggravated assault on a peace officer and multiple other criminal charges. Court records show he also has a criminal warrant out of Nevada.
